TBS Files Class Action Complaint against MultiCare Health Systems, Inc.

On July 7, 2014, Tousley Brain Stephens PLLC filed a class action complaint against MultiCare Health Systems, Inc. in the U.S. District Court for the Western District of Washington. The complaint was filed on behalf of a class of persons who received non-emergency telephone calls from Hunter Donaldson on behalf of MultiCare to a cell phone through the use of an automatic telephone dialing system or an artificial or prerecorded voice and did not provide prior express consent. The complaint alleges that MultiCare is liable for violations of the federal Telephone Consumer Protection Act (TCPA) and the invasion of privacy by intrusion under Washington law during the class periods.

The class period for the TCPA claims is from July 10, 2010 to present.

The class period for the invasion of privacy by intrusion claim extends from July 7, 2011 to present. MultiCare operates numerous hospitals and health clinics throughout Washington State. MultiCare contracted with a third party, Hunter Donaldson, to place calls on MultiCare’s behalf to individuals who had received health care at a MultiCare facility. Specifically, the complaint alleges that MultiCare is liable for all automated or prerecorded calls that Hunter Donaldson placed on MultiCare’s behalf without prior consent throughout the class periods to individuals who had received health care from MultiCare.
