Court Preliminarily Approves Settlement in Banner Bank Class Action

On September 2, 2021, United States District Court Judge Stanley A. Bastian preliminarily approved a settlement in a putative class action lawsuit against Banner Bank over allegations that the bank engaged in a practice of charging excessive fees on Retry Insufficient Fund (“NSF”) and Overdraft (“OD”) Fees.

As part of the settlement, Banner Bank has agreed to create a cash Settlement Fund of $1,000,000, which after deductions of Court-approved fees, expenses, and service awards, will be used to make cash payments to class members by direct deposit or by check. In addition, Banner Bank modified its disclosures to reflect its practices with respect to NSF and OD Fees, and will pay the costs for distributing notice to the class and for administration of the Settlement separately. The case is Gonzalez, et al. v. Banner Bank, Case 4:20-cv-05151-SAB, in the U.S. District Court for the Eastern District of Washington. The hearing for final settlement approval is scheduled for February 10, 2022 at 10:00 a.m.
