Navistar MaxxForce Engine Defective Emissions System Class Action
TBS represents truckers in a case against heavy duty diesel truck manufacturer Navistar in U.S. District Court for the Northern District of Illinois; alleging that Navistar, Inc. and Navistar International, Inc. sold or leased 2011-2014 model year vehicles equipped with certain MaxxForce 11- or 13-liter diesel engines equipped with a defective EGR emissions system.
On June 12, 2019 Untied States District Judge Joan B. Gottschall preliminarily approved a proposed settlement of $135 million settlement provides class members with up to $2,500 per truck or up to $10,000 rebate off a new truck depending on months of ownership or lease, or the option to seek up to $15,000 per truck in out-of-pocket damages caused by the alleged defect.

The deadline to file any claims is May 11, 2020. The court-appointed settlement administrator will mail a notice to every person it believes to be a member of the class and for which it can find contact information.
A Fairness Hearing for final approval of the Settlement Agreement is scheduled for November 13, 2019.
