Case Details

Tousley Brain Stephens serves as local counsel in a putative class action filed against Boeing Employees Credit Union (BECU) on August 1, 2019. The complaint alleges the Washington credit union is engaged in a practice of charging excessive fees on debit and ACH transactions. Specifically, BECU is (a) assessing Overdraft Fees (OD Fees) on transactions that do not actually overdraw checking accounts; and (b) charging two or more Non-Sufficient Funds Fees (NSF Fees) on a single transaction. Plaintiffs claim these practices are in breach of BECU’s form contracts with its consumers, and are unfair and deceptive practices in violation of the Washington Consumer Protection Act.
