Swinomish Indian Tribal Community Files Suit to Stop Bakken Crude Oil Trains

Tousley Brain Stephens represents the Swinomish Indian Tribal community in litigation filed against BNSF for breach of an easement agreement limiting the number of trains and cars crossing the Tribe’s reservation. BNSF recently began, without notice to or the agreement of the Tribe, significantly exceeding the limitations set in the easement by running 100-car unit trains containing highly volatile Bakken crude oil.
