Lawn Mower Fraud Investigation

We are currently investigating complaints that certain manufacturers and sellers conspired to defraud consumers by misrepresenting and falsely advertising the horsepower of their lawn mower engines; i.e., that they manufactured and sold lawn mowers with identical engines as different products with different ratings, and charged higher prices for the falsely represented higher horsepower engines. It is believed they have engaged in this practice 10 or more years. These manufacturers and sellers include:

• Sears, Roebuck and Co. (sold under the brand name "Craftsman")
• Kmart Holding Corporation (sold under the brand name "Craftsman")
• Deere & Company
• Tecumseh Products Company
• Kawasaki Heavy Industries, Ltd.
• Kawasaki Motors Corp.
• Kawasaki Motors Manufacturing Corp.
• MTD Products (sold under the brand names "Troy Built", "Yard-Man," "Yard Machines," "Bolens," and "White Outdoor")
• The Toro Company (sold under the brand names "Toro," "Lawn-Boy" and "Exmark")
• American Honda Motor Company
• Electrolux Home Products (sold under the brand names "Poulan," "Poulan PRO," "Weed Eater" and "Husqvarna")
• Husqvarna Outdoor Products, Inc.
